    In this presentation attendees will get to catch up on an eventful start to 2026 for the Department of Labor (DOL) and the National Labor Relations Board (NLRB), with both federal agencies making big changes to the way independent contractor and joint employer relationships in the workplace are defined and enforced. On the DOL side, audience members will learn about the DOL’s new proposed Independent Contractor Rule that will be throwing out the 2024 Biden-era Rule, and restoring the 2021 Trump-era Rule that focuses on the “economic reality test.” This presentation will examine the “Core Factors” and “Additional Factors” that all employers should know when analyzing whether or not they are properly classifying independent contractors.  The audience will also learn about the NRLB’s new Joint Employer Rule, and how to get prepared for the NLRB’s focus on “vertical” and “horizontal” joint employment relationships, as well as the four-factor test that all employers should know and understand to make sure that they are not inadvertently jointly employing personnel with another company.

    • To arm HR professionals with the knowledge they need to prepare their companies to keep up with these shifting sands of regulatory change, so that their workforce is properly classified on all fronts. 
    The session will be held in Classroom D113. You will enter via Entrance 2 and park in Parking Lot D. Lunch will be provided. RSVP is required. 


    Adam W. Childers serves as President and CEO at Crowe Dunlevy, and is the chair of the firm's Labor & Employment Practice Group. Adam is currently an Administrative Law Judge at the Oklahoma Department of Labor and a member of Phi Beta Kappa and the Order of the Barristers. 


    The Best Lawyers publication selected Adam for inclusion in Best Lawyers in America 2015-2025 for Labor and Employment litigation, and named him Oklahoma City 2020 Lawyer of the Year for Employment Law – Management, and 2022 Lawyer of the Year for Labor Law – Management. He has been ranked in Chambers USA since 2011, including a Band 1 ranking for Labor & Employment law since 2021. Adam has achieved the BV peer review rating given by LexisNexis Martindale-Hubbell.
